By entering the Competition, you are agreeing to the following terms and conditions: 

Standard Terms: 1. Information on how to enter forms part of the terms and conditions of entry. 2.  By entering the competition, all entrants will be deemed to have accepted and agreed to be bound by these terms and conditions of the competition. 3. Headings in this document are included for ease of reference, and do not affect interpretation in any way. 4.The claimant is responsible for ensuring his or her familiarity with the Terms at the time of participation. The Promoter’s decision not to enforce a specific restriction (whether communicated to a claimant or not) does not constitute a waiver of that restriction or of the Terms generally. 5. All claimants acknowledge that the Promoter can rely on these Terms even if the Promoter only learns of a person’s ineligibility after the Promoter has awarded the prize to the ineligible person. 6. The Promoter’s decision in relation to any aspect of these Terms and the Promotion is final and binding on every person who enters. No correspondence will be entered into. 7. This is a game of skill. Chance plays no part in determining the winner. Each entry will be individually judged based on set criteria of creativity (use of imagination, originality (is it a novel idea) and uniqueness (is it especially remarkable or unusual). The winning entry will be chosen democratically by three independent judges. 8. Each entry must be an independent creation by the entrant. Entries must not have been published previously and/or have been used to win prizes in any other competitions. 

Who can participate? 9. The Promotion is only open to Australian residents aged 18 years or older, excluding (“In-Eligible Claimants”):- 1. management, employees, directors and contractors of the Promoter, its related entities, the Participating Outlets and other agencies, firms or companies associated with the Promotion (including suppliers of the prize); 2. the immediate family, which means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin; and 3. persons who have breached the terms and conditions of any promotion run by or on behalf of the Promoter. 4. This promotion is not open to professional photographers. 

Promoter Details: 10. The Promoter is the Merial Australia Pty Ltd, Level 2, 16 Giffnock Ave, Macquarie Park, NSW 2113 ABN 53 071 187 285. 

Duration: 11. The promotion commences 1 September 2017. Entries close 5.00pm Eastern Standard Time 30 November 2017. 

How to Enter: 12. To enter, entrants must upload their best sheep farming photo and complete the entry form at www.facebook.com/4theloveofsheep or www.4theloveofsheep.com.au 13. The Promoter reserves the right to verify the validity of entries. 14.Multiple entries permitted, subject to the following: 1. each entry must be submitted in accordance with entry requirements; and 2. Incomplete, ineligible, indecipherable or incorrect entry forms will be deemed invalid. 

Prize: 15. 1st Prize includes a DJI Phantom 4 Pro Drone, 12.9 Inch iPad Pro, Apple Pencil & Canon Powershot G9X Mark II Camera. Runners Up can win 1 of 12 10.5 inch iPad Pro’s. Total prize pool to the value of $AU13,400.00. 1. The prize is non-transferable and non-redeemable for cash. The prize cannot be exchanged. In the event that, for any reason whatsoever, a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize. 

General: 16. The competition judges reserve the right to disqualify any entrant submitting an entry which, in the opinion of the judges, includes objectionable content, including but not limited to profanity, nudity, potentially insulting, scandalous, inflammatory or defamatory images or language. The judges' decision will be final and no correspondence will be entered into. 17. All entries become and remain the property of the Promoter. 18. The Promoter reserves the right to withdraw or amend the competition as necessary due to circumstances outside of its control. 19.The Promoter is bound by the Australian Privacy Principles ("APPs") and adheres to these Principles. The personal information the Promoter collects from the entrant will be used for the purpose of enabling the entrant's participation in this promotion, to notify the entrant if the entrant has won and to provide the entrant with other educational and promotional communication ("this purpose"). If the entrant does not provide all or some of the requested personal information to the Promoter, the Promoter may not be able to register the entrant for this promotion, the Promoter may not be able to contact the entrant if the entrant has won and will not be able to keep the entrant up-to-date with other educational and promotional communications.  The Promoter may disclose the personal information to third party contractors who the Promoter may engage to assist with this purpose. The Promoter may keep the entrant's personal information in secure databases that may be hosted on servers that are located outside of Australia (such as in the USA, Japan, Singapore and Germany), in which case the Promoter may disclose the personal information to those overseas hosting providers for that purpose only. The Promoter may also disclose the personal information to its related entities and Affiliates (as defined in its Privacy Policy) some of which are located outside of Australia including but not limited to New Zealand, Germany and the USA. The Promoter's Privacy Policy (at https://www.boehringer-ingelheim.com.au/data-privacy) contains information about how the entrant can access and request the correction of the entrant's personal information, how the entrant can make a complaint about a breach of the APPs and how the Promoter will deal with the complaint. The Promoter's Privacy Officer can be contacted at privacyofficer.syd@boehringer-ingelheim.com. 20.All entries become the property of the Promoter. The Promoter may use the entrant's names and photo for any commercial purpose, including future promotional marketing and publicity purposes. The Promoter may also request Hi Resolution version of the submitted image. 21. Entries will be judged at Merial Australia on 15 December 2017 by the set criteria as outlined on the competition entry form and the winner’s name will be published on the Merial website within 30 days of the winners judging. 22. The winner will also be notified in writing by email within thirty (30) working days of the conclusion of the competition. If the Promoter is unable to contact the winner within 30 days of the draw and the Promoter has made every effort to contact them with the information provided by the entrant on the entry form then the Promoter will award the prize to another valid entrant. 23. All entrants who choose to ‘opt-in’ consent to have their contact details (title, first name, surname, email, mobile or landline phone number, mailing address and post-code only), for the Promoter to use in ongoing marketing. 24. The: 1. Promoter, the Promoter's related entities, the Participating Outlets and all agencies associated with the Promotion; and 2. the employees, agents, directors and contractors, of all entities referred to in paragraph 9, shall not be liable for any loss or claim, action, demand, liability, damage, cost, expense or personal injury whatsoever (including but not limited to any direct, indirect or consequential loss), incurred, suffered or sustained by any person or entity (without limitation) in connection with, or arising from, the Promotion or the acceptance or use of the prize, except that which cannot be excluded by law (in which case that liability is limited to the maximum extent allowable by law). 25.CAUTION: Any attempt to deliberately undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. 

Promoter's Rights: 26. If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (i) to disqualify any entrant; or (ii) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Competition, as appropriate.  

Limitation of liability and variation of terms: 27. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoters’ ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoters may in their absolute discretion cancel the Competition and recommence it from the start on the same conditions, subject to state government legislation. 1. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory Consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar Consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). 2. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury or any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of the Competition, including but not limited to the following: 1. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); 2. any theft, unauthorised access or third party interference; 3. any entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; 4.  any tax liability incurred; or 5. the use or enjoyment of the Prize. 3. The Promoter, its related bodies corporate and their respective officers, employees, contractors and agents (“Promotion Parties”) will not be liable for any losses, damages, expenses, costs or personal injuries arising out of this promotion, the promotion of this promotion or the use of the Prize, including but not limited to any breach of these terms and conditions, contract or tort (including negligence) and any other common law, equitable or statutory remedy (“Damages”) whatsoever, including but not limited to direct, indirect and consequential Damages, including Damages that cannot reasonably be considered to arise naturally and in the ordinary course of things, even if those Damages were in the contemplation of the Promotion Parties.
